Welcome to Flairz Health, and thanks for taking the time to read our Privacy Policy. NexvisionIX., the provider of Flairz Health, is committed to protecting the information of those individuals who use the Flairz Health mobile software applications (the “Flairz Health App“¯) and Flairz Health-branded websites or other web applications (our “Sites“¯, together with the Flairz Health App, the Connected Devices, as defined below, and other services that we may provide in connection with the foregoing, our “Service“¯). Our Service helps you track your activities, what you eat, and your insulin and blood glucose levels in order to enhance your ability to make lifestyle choices. This Privacy Policy sets out how we collect, use, and share information that we obtain from your use of our Service or from other sources. This includes data we collect from devices that you choose to connect to our Service to help you track your activities, such as Flairz Health-branded or third-party devices that measure physical activity or blood glucose levels (“Connected Devices“).

In particular, this Privacy Policy sets out:

Information We Collect

Registration and Profile Information

You must create a Flairz Health account in order to use our Service. You can create an account by providing your name and email address. You may also create an account by providing credentials to a social media account profile.

You may also voluntarily add or edit your Flairz Health profile information such as phone number, gender, height, and weight, and information related to your diabetes management such as your diabetes type, year of diagnosis, glucose range, A1C level, and brand of insulin, insulin pump, and glucose meter.

Information Access and Collection

This mobile application may access or collect personal information and non-personal information. This information is accessed and collected in a variety of ways, including through the operating system of your mobile device and through information you submit through the mobile application.

Information You Post

We collect the moments you post when using our Service, such as photos, insulin levels, blood glucose readings (whether directly entered or transferred via a Connected Device), and notes that you create to accompany your moments. Respecting other people’s privacy is important. Please do not post any content that includes identifying information about another person without that person’s explicit consent.

Location Information

We offer features that require specific location data, such as the “Move”¯ and “Food”¯ tools. If you choose to use these features, we will collect data about your physical location from your mobile device if your Operating System settings are enabled to send it to us. We stop collecting this type of data when you stop using the feature.

Information Stored on Your Mobile Device

With your permission, we may collect information stored on your mobile device, such as photos, or access resources on your mobile device, such as the camera.

Payment Information

Certain purchases through our Service may require that you provide financial account information, such as your credit card number, to our third-party service providers. Purchases for virtual goods are handled by third party app stores such as Apple’s App Store and Google Play. We are not responsible for their policies and practices.

Communications

We will collect information you provide when you communicate with us, such as any communications you send to customer support. We will also collect information that you may submit as part of participation in a promotional event.

Information Others Share About You

Users may provide information to our Service when uploading photos and tagging moments with notes, and we cannot control whether users post information about you. Users may also provide your email address or phone number to us to invite you to use our Service.

Persistent Log-In

If you choose to use a persistent log-in, for example, having your user name or password be remembered, others may be able to access information through your mobile device. If you are concerned about the unauthorized use or disclosure of information via your mobile device, you should lock your mobile device when not in use or elect to not use the persistent log-in feature.

Flairz Health Cookies and Usage Data

We collect industry standard data from everyone who visits our Service. We use common technologies, such as cookies, “clear gifs”¯ and “web beacons,”¯ to automatically collect information such as your IP address or other device address or ID, web browser and/or device type, the web pages or sites that you visit just before or just after you use our Service, the pages or other content you view or otherwise interact with on our Service, and the dates and times that you visit, access, or use our Service. We also may use these technologies to collect information regarding your interaction with email messages, such as whether you opened, clicked on, or forwarded a message. This information is gathered from all users, and may be connected with other information we collect from you.

Third Party Applications

You may have the option of integrating your Flairz Health account with Apple HealthKit and third party applications that integrate with Healthkit. If you choose to do so, we may request your permission to access information about you from Apple and from third party applications. We will not access this information without your permission.

How We Use Your Information

To Provide the Service. We use your information to provide, personalize, analyze, improve, and promote the Service.

Communications. Contact information is used to communicate with you, including by sending email messages, push notifications, or text messages. We may send administrative messages such as those related to account management, customer service, or system maintenance, or to inform you about new features or products that we think you would be interested in.

Aggregate Data. We may anonymize and aggregate data collected through our Service and use it for any purpose.

With Your Consent. We will use your information for any other purpose for which the information was collected or for which you provide consent.

How We Share Your Information

Displaying to Other Users. Our Service offers many ways to find and share useful content. The moments that you post will be publicly displayed on our Service, such as your photos, meals, activities, exercise, and insulin and glucose levels, and information about your notes that you tag moments with, your likes, or stickers you share with others. We encourage you to carefully consider the information you share. We cannot control how other users treat the posted information.

We will not display your registration or profile information to other users, but your initials will publicly displayed along with your moments and other public content.

Please read “Preferences”¯ below to learn about what controls we offer over the sharing of your data.

Vendors and Service Providers. We may share information we receive with vendors and service providers we use in connection with providing our Service. For example, analytics providers help us understand the use of our Service.

Third Party Applications. We offer the ability to integrate your Flairz Health account with Apple’s HealthKit. If you do, we will share your information with Apple if you give us permission to do so. If you connect your Flairz Health account to a third party application through HealthKit, you may be asked to share your information with that application. We will not share your information without your permission.

We also enable you to publicly post particular Flairz Health moments, on an individual basis, to third party applications such as social networking services. A third party application’s use of your information is governed by its privacy policy and your settings on the application.

Flairz Health will not use or disclose to third parties user data gathered from HealthKit for advertising or other use-based data mining purposes other than improving health.

Aggregate Data. We may share aggregate data that does not identify you with third party partners.

As Required By Law and Similar Disclosures. We may access, preserve, and disclose information if we believe doing so is required or appropriate to: comply with law enforcement requests and legal process, such as a court order or subpoena; respond to your requests; or protect your, our, or others’ rights, property, or safety.

Merger, Sale, or Other Corporate Transactions. If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of our assets, or transition of service to another provider, your information may be sold or transferred as part of such a transaction as permitted by law and/or contract.

With Your Consent. We may also disclose your information with your permission.

Information Security

We use certain physical, managerial, and technical safeguards that are designed to improve the integrity and security of personal information that we collect and store. Please be aware that no security measures are perfect, and we cannot ensure or warrant the security of any information you transmit to us or store on our Service.

Our Policy Towards Children

Our Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we learn that we have collected personal information of a child under 13, we will delete such information.

International Users

If you are visiting from the European Union or other regions with laws governing data collection and use that differ from those of the United States, please note that your information, including your personal information, will be transferred to the United States and processed in the United States or elsewhere. By providing your information to us you consent to any transfer and processing in accordance with this Privacy Policy.

Accessing or Modifying Your Information

You may update, correct, or delete your registration and profile information at any time by accessing your account settings. If you wish to request access to or correct other personal information we hold about you, you may contact us at privacy@flairzapp.com.

Preferences

We provide you with settings that allow you to adjust your sharing preferences. Please carefully use our Service and review your account settings.

Our settings may also allow you to adjust your communications preferences. If you receive promotional email from us, you may unsubscribe at any time by following the instructions contained within the email. You may also opt out from receiving promotional email from us by sending your request to us by email at privacy@flairzapp.com or by writing to us at the address given at the end of this policy. Please be aware that, even after you opt out from receiving promotional email from us, you will continue to receive administrative emails from us regarding the Service. You may turn off push notifications through your device settings.

Changes to Our Privacy Policy

We may revise this policy from time to time. When we do, we will post the revised policy on this web page, and the revised version will be effective when it is posted. If we make any material changes to this policy, we will notify you of such changes by posting them on this page or by sending you an email or other notification, and we will indicate when such changes will become effective. By continuing to access or use our Services after those changes become effective, you are agreeing to be bound by the revised policy.
